Senate Democrats in New Mexico have moved forward with Senate Bill 30 (SB 30), choosing to repeal the state’s abortion reporting statute, which has not been enforced since 2019. This decision was made despite acknowledging that the law is outdated and that New Mexico is one of the few states still requiring abortion data reporting by law. Sen. Peter Wirth, who sponsored the bill, described the statute as “over 50 years old” and “out of date.”

The repeal means that there will be no replacement for the reporting requirements, eliminating any existing transparency and accountability mechanisms. Tara Shaver, spokeswoman for Abortion Free New Mexico, criticized SB 30 for not improving healthcare or protecting patients but instead removing transparency.

During a hearing on SB 30, a Planned Parenthood representative disputed claims made by Shaver regarding Medicaid funding for abortions in New Mexico. The representative said that Medicaid caps abortion services at $750, referencing the All-Payer Claims Database (APCD). However, Shaver argued that this database does not set policy or impose caps.

Shaver emphasized the need for public accountability when taxpayer dollars are used to fund elective abortions. She highlighted that costs can vary significantly depending on gestational age and medical complexity, with third-trimester abortions potentially costing up to $17,500.

Supporters of SB 30 argue that abortion reporting is an unnecessary burden on providers. In contrast, Shaver contends that providers already collect extensive data voluntarily and object only to public accountability.

Abortion Free New Mexico acknowledged Senators David Gallegos, Jay Block, Larry Scott, and Rex Wilson for opposing SB 30 and raising concerns about transparency and accountability during hearings. The organization continues to advocate against SB 30 as it progresses through the committee process.
